🅿️ The one question that decides everything: coupled or separate?

Before you fill in a single field, know this: in Swiss tenancy law a parking space has no single, uniform statute. How it is treated depends entirely on its legal link to your flat. This is where it is decided whether you get three months' notice and full protection, or two weeks and none. Confusing the two means giving notice too late, paying months too much, or suddenly losing your space.

If the space is in the same lease as the flat, the two form a single tenancy: the accessory (the space) follows the fate of the main thing (the flat). If it is rented separately, on its own contract, perhaps by a different landlord, it is an independent rental object, and the short deadlines of Art. 266e CO apply. If the contract is silent, the parties' intent and the connection decide, so make it clear from the start.

Coupled vs. separate: two worlds compared

The same garage, two completely different legal situations depending on how it is rented:

Coupled (in the flat's lease) → strong protection
The space is an accessory to the flat. Terminable only together with it, on the official form, with 3 months' notice for the customary date and full protection. The abusive-rent protection also applies. The landlord cannot take the space away on its own.

Separate (own contract) → weak protection
The space is an independent object. Art. 266e CO allows termination with just 2 weeks' notice for the end of a one-month period, no official form, no protection. The rent is free and cannot be challenged as abusive.

Unclear → the parties' intent decides
Two separate contracts with the same landlord may still form a connected tenancy. Individual termination then requires the official form. In doubt, the conciliation authority decides, free of charge.
Context
Rule of thumb: one contract, one fate. If, as a landlord, you want to terminate flat and space separately, you need two distinct contracts with clearly documented intent. If, as a tenant, you want to keep the space for sure, put it in the flat's lease. To end the whole flat, terminating the lease shows you the correct dates.

A parking space looks simple, and that is exactly why rushed contracts miss the decisive lines. A contract that really holds needs six building blocks, and it is the missing coupling clause that has landed many a garage story before the conciliation authority. Four of these five mistakes cost money, one can cost you the space, and the costliest is also the most invisible, because it only surfaces when notice is given. Read them once and you won't fall for any.

Not settling the coupling. The classic. If nowhere it says whether the space belongs to the flat, a dispute erupts the moment someone wants to terminate just the space. One clear line in the contract prevents it, use the generator above.

Assuming the wrong notice period. Counting "3 months" on a separate contract means giving notice too late and paying for nothing; counting "2 weeks" on a coupled space earns you an invalid termination. The coupling check and the notice calculator above tell you what really applies.

Overlooking the VAT trap. A separately rented parking space is an independent service and is in principle subject to VAT (currently 8.1%), unlike residential rent, which is always exempt. For a private person with a single space, the exemption threshold of CHF 100,000 annual turnover applies, but commercial landlords must add VAT to the rent. Coupled to the flat, the space stays tax-free.

Only agreeing verbally. "The space is yours as long as you like" is worth nothing before the conciliation authority. Without a written contract you are empty-handed in a dispute. Two minutes of generator save months of trouble.

Not clarifying use and charging power. Turning the space into storage or wiring up an EV charger without agreement risks a warning and back-payment. Set out the purpose of use and the electricity billing in the contract.

The invisible difference with real money value: if, as an owner, you rent your space to someone who does not live in your building, it is almost always a separate contract, with short notice and potential VAT liability. Genau die Frage, die mir keiner beantworten konnte: Mein Parkplatz war im Wohnungsvertrag, und der Verwalter wollte ihn mir trotzdem separat kündigen. Dank dem Kopplungs-Check wusste ich, dass das gar nicht geht. Kündigung zurückgezogen.

Stark, Reto, genau so ist es. Steht der Platz im selben Vertrag wie die Wohnung, ist er Nebensache und kann nicht einzeln gekündigt werden. Gut, dass du dich gewehrt hast, viele zahlen in so einer Lage einfach weiter.

Den Kündigungsrechner habe ich dreimal gebraucht, bis ichs geglaubt habe. Mietbeginn war der 15., also kann ich nur auf den 14. kündigen, nie auf Monatsende. Hätte ich beinahe falsch gemacht und einen Monat zu viel gezahlt.
