⚖️ Your rights after a rejection

Two legal points matter in the moment after a rejection, and both are regularly confused. The first concerns your data, the second a deadline that starts running with the rejection.

What applies in Switzerland
  • Your documents: once the selection process is complete, the documents of rejected applicants must be returned according to the guidance of the Federal Data Protection and Information Commissioner, and copies must in principle be destroyed. They may only be kept longer if the applicant consents and a date is fixed in advance. That is exactly why this sentence appears in our talent pool templates.
  • No duty to give reasons: there is no general right to be told the reasons for a rejection. You may still ask, and many companies do answer.
  • Discrimination exception: anyone who suspects discrimination within the meaning of the Gender Equality Act may demand written reasons. Compensation under Art. 5 para. 2 GEA is forfeited unless proceedings are brought within three months of notification of the rejection, and amounts to at most three months' salary.
