🛍️ Shopping on Sunday — what differs here
«Without preconditions» is a phrase one rarely reads in a statute, and here it carries the whole meaning. It does not say that two Sunday openings are permitted — it says the municipal authority needs no justification for them. That is something else, and the difference shows as soon as you read on: for every further opening, Art. 11 lit. c demands a proven urgent need.
In practice: two are near certain — but hardly more, because the hurdle is not a matter of discretion but a burden of proof. The canton of Schaffhausen therefore belongs to those that do not use up the federal ceiling of four — together with Basel-Stadt, Lucerne and Valais. And unlike them, the reason here is not a smaller number in the act but a condition that makes the rest practically unreachable.

«Voraussetzungslos» — das Wort staht würkli so im Gsetz. Zwei ohni Begründig, alles wytere nur mit Nachwis. Das erklärt, warum s bi üs nie meh als zwei gits.
Wir liegen näher an Schaffhausen als an Zürich, aber der Zürcher Kalender hilft uns null. Dass die Gemeindebehörde bewilligt, heisst: Neuhausen kann andere Tage haben als die Stadt.
Genau so ist es, Art. 11 des Ruhetagsgesetzes gibt die Bewilligung der zuständigen Gemeindebehörde. Darum steht bei uns für Schaffhausen die Regel statt eines kantonalen Datums — und darum lohnt der Blick auf die eigene Gemeinde.
Interessant: Das Schaffhauser Gesetz ist von 1977. Man merkt es am Ton — «freigestellt», «voraussetzungslos». So schreibt heute niemand mehr.
